TERMS AND CONDITIONS

FOR TICKET BUYERS

1. WHO YOU ARE BUYING FROM

We Scan Tickets Ltd provides the software system and transactional infrastructure by which Event Organisers make their tickets available for purchase online by you, the Customer.

We Scan Tickets Ltd merely facilitates the transaction between Event Organisers and Customers. We do not set ticket prices or determine availability of tickets. We simply handle the booking process and collection of payments on behalf of Event Organisers when you purchase tickets online.

2. EVENT INFORMATION

All details of Events including, but not limited to, performance times, venue, ticket prices and seat availability are entered onto the We Scan Tickets Ltd website by the Event Organiser. The accuracy of all such information is at all times the responsibility of the Event Organiser.

3. TICKET SALE PROCESS

The site will display the payment due for the tickets specified which will include any booking fees. You will then be asked to submit credit or debit card details, the We Scan Tickets Ltd system will charge the card issuer the appropriate amount. On completion of the transaction, the chosen tickets will be registered in your name and you will be sent confirmation of booking via email or via text message (if applicable).

We recommend that when using the site you ensure that you are only using one browser window. Using multiple browser windows could result in you losing your ticket selection, duplicate charges or timer expiration. When making payment, you must not use the "back" button on your browser as this may cause you to lose your ticket selection or result in a duplicate booking.

4. CURRENCY

Payment for tickets sold through We Scan Tickets Ltd are in Great British Pounds.

5. ORDER CONFIRMATION

Order confirmation will take the form of a summary web page at the end of the purchase sequence. This will be followed by a booking confirmation email dispatched to you. Both contain details of the tickets purchased and a unique purchase ID, which acts as your proof of payment and may be used by the Event Organiser as an eticket.

If you do not receive a confirmation ID (in the form of a confirmation page or email) after submitting payment information, it is your responsibility to confirm with our Customer Service Department whether or not the order has been completed, as only you may be aware of any problems that may occur during the purchase process. We Scan Tickets Ltd will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation.

Any ticket-holder unable to present confirmation of purchase in the form of a print out of the email (or web page equivalent) and valid identification indicating they are the individual named on the confirmation may not be admitted to the event, and will not receive a refund.

6. DISPATCH OF TICKETS

Tickets can be issued in two different formats:

  • Digital ticket (A Web based ticket sent to you via email, these tickets are optimised for mobile devices and can be printed.
  • Tickets by text (A unique web link will be sent to your mobile phone which will simply open the web based tickets mentioned above.

Charges may apply to the dispatch of some tickets (text message). Charges will be listed through the purchasing process. Ticket dispatch fees are non-refundable.

7. EXCHANGES AND REFUNDS

Before placing a booking, carefully review your event and ticket selection. Once purchased tickets cannot be exchanged or refunded unless the Event Terms and conditions state otherwise.

The varying exchange and refund policies set forth by Event Organisers prohibit We Scan Tickets Ltd from initiating exchanges or refunds after a booking is placed or if a ticket is lost or stolen. In the event of such reversal of transaction being desired, you should contact the Event Organiser directly, as they may, at their discretion, agree to your wishes.

Booking fees whether originally presented as a separate item or included within the stated face value of the ticket are non-refundable unless the organisers refund policy allows refunds due to cancellation. When you purchase tickets and agree to these terms, you are also agreeing to the events terms and conditions which includes their refund policy.

8. CANCELLED EVENTS

8.1 OVERVIEW

If an Event is cancelled by the Event Organiser (i.e. a cancellation due to circumstances beyond the Event Organiser's control), and the organisers refund policy allows refunds to occur. The full ticket value including your booking administration fee, (but excluding any dispatch charge for example text message fee) will be refunded.

Some Event Organisers will explicitly stipulate that cancellation due to weather, act of God or any other unavoidable eventuality will not result in a refund. If such terms have been applied, they will be displayed in the events terms found during the checkout process or on the events associated website. The events terms shall prevail over the provisions above, meaning that no refund will be due.

We Scan Tickets Ltd will not be responsible for the funds for your tickets or responsible for handling your refund process.

We Scan Tickets Ltd is normally notified in advance of any pending Event cancellation by the Event Organiser. You can also notify We Scan Tickets Ltd directly if you discover that an event has been cancelled by contacting us

8.2 EVENT SPECIFIC TERMS AND CONDITIONS

This ticket is issued subject to the terms and conditions of the Event Organiser, if applicable. Breach of any of these terms and conditions or any unacceptable behaviour likely to cause damage, nuisance or injury shall entitle the Event Organiser to eject you from the venue.

It is your responsibility to comply with any age restrictions which apply to the event or the venue where the event is being held.

We Scan Tickets Ltd will under no circumstances be responsible for any remedy for inconvenience, consequential expenses incurred or any other loss or damages resulting from the cancellation of any Event.

Please note, it is your responsibility to check whether the Event is going ahead at the scheduled date, time and venue, and We Scan Tickets Ltd cannot guarantee that they will inform you of any changes to the event date, time or venue

9. UNLAWFUL RESALE OF TICKETS

The unlawful resale (or attempted unlawful resale) of a ticket is grounds for seizure or cancellation of that ticket without refund or other compensation.

10. YOUR PRIVACY

10.1 CUSTOMER DATA

In respect of any personal data as defined in the General Data Protection Regulations (Regulation (EU) 2016/679), also known as GDPR, the Event Organiser holds responsibility to ensure that they comply with the Regulations and continue to comply with any future amendments to the Regulations and any guidance notes or guidelines issues by the Information Commission.

Subject to all applicable data protection legislation, all Customer personal data generated in connection to your Event shall be owned by the Event Organiser and / or their Organisation (as the Data Controller) and, subject to any relevant consents being granted by the Customer under GDPR, shall be entitled to use such Customer data in whatever manner it sees fit. We Scan Tickets Ltd as the Data Processor is permitted by the Event Organiser to access a Customer’s Personal Data to be able to deliver the Service as outlined in these Terms and Conditions of Use and the Data Processing Agreement.

We Scan Tickets Ltd is dedicated to providing a high quality and secure service to its customers. We are fully PCI DSS compliant and adhere to the General Data Protection Regulations as a Data Processor (for processing ticket-buying customer's data) and as a Data Controller (for processing Event Organiser's data). We are committed to only using servers physically located within the UK for our UK based services.

10.2 INFORMATION WE COLLECT FROM YOU

In order to operate the site, provide We Scan Tickets Ltd Services, conduct ticket purchase transactions and provide you with information on products and services that may be of interest to you, we collect three classes of information about you:

  • "Contact information" (i.e. information that could be used to contact you such as full name, postal address, phone number and email address, which is then permanently stored on our database.
  • "Demographic information" (e.g. postal code, hometown, gender and age) from you, which is also permanently store on our database.
  • "Financial information" (i.e. credit and debit card numbers) however this information is not stored on our database.

When processing your order, we will ask you for your name, email address and postcode. This is essential for all advanced bookings.

Your details are encrypted on the We Scan Tickets Ltd servers, which is stored in a secure location. Our servers are located in the United Kingdom. The server is password protected and can only be accessed by authorised staff. When personal data is input into We Scan Tickets Ltd, we use appropriate physical, electronic and managerial security measures to try to prevent that personal data from being accessed by unauthorised persons and to ensure that you may input personal data safely. This means that sometimes we may ask for proof of identity before we disclose personal data to you. When inputting card details for payment, the system encrypt all your personal information including credit/debit card number. So that it cannot be read if intercepted by a malicious third party. We Scan Tickets Ltd does not store any credit/debit card data.

11. DISCLAIMER

The site and its content are delivered on an "as-is" and "as-available" basis. We Scan Tickets Ltd disclaims all warranties, express or implied, including also any implied warranties of merchantability and fitness for a particular purpose.

We Scan Tickets Ltd does not promise that the site will be error-free, uninterrupted, or that it will provide specific results from use of the site or any content, search or link on it.

We Scan Tickets Ltd cannot ensure that files you download from the site will be free of viruses or contamination or destructive features.

We Scan Tickets Ltd will not be liable for any damages of any kind arising from the use of this site, including without limitation, direct, indirect, incidental and punitive and consequential damage. We Scan Tickets Ltd makes no guarantee of any specific result from use of this site or use of the We Scan Tickets Ltd service.

12. LIMITATION OF LIABILITY

Whilst we endeavour to ensure that the website is fully operational at all times, on those occasions when there are interruptions to service due to essential maintenance, system upgrades, internet service interruptions or any other factors beyond our control, We Scan Tickets Ltd will not be liable for any indirect, consequential, exemplary, incidental, special or punitive damages, or for lost profits, revenues or business opportunities, even if We Scan Tickets Ltd has been advised of the possibility of such damages.

Neither We Scan Tickets Ltd nor the Event Organiser shall have any further liability beyond the face value of the ticket purchased plus the booking fee. Neither We Scan Tickets Ltd nor the Event Organiser shall be liable for any loss of enjoyment or wasted expenditure. Personal arrangements including travel, subsistence and accommodation relating to the Event which have been arranged by you are at your own risk.

We Scan Tickets Ltd disclaims any and all liability for the acts, omissions and conduct of any third party users, We Scan Tickets Ltd users, advertisers and / or sponsors on the site, in connection with the We Scan Tickets Ltd service or otherwise related to your use of the site and /or the We Scan Tickets Ltd service. We Scan Tickets Ltd is not responsible for the products, services, actions or failure to act of any venue, performer, promoter or other third party in connection with or reference on the site.

Notwithstanding the foregoing, nothing in the Agreement shall be taken to limit or exclude any liability which We Scan Tickets Ltd may have for (i) death or personal injury arising from We Scan Tickets Ltd negligence; (ii) fraudulent misrepresentation; or (iii) any liability that cannot be excluded or restricted by law.
